Additionally, the Recommended Preliminary Search and Opinion includes a search of domain names ending in dot com, dot net and dot org. When reviewing domain names, we do not merely determine whether or not the domain exists, which is what most firms do. We also look to see if the domain is currently hosting an active web page, and if so, whether the content of that page appears to be related to the type of goods or services you will sell. We believe it is absolutely worthwhile to search domain names before spending money on a more expensive search. This is an easy and cheap way to determine whether an unregistered mark exists that may interfere with trademark rights in your proposed mark. If you prefer to save $30 and do your own domain name searching, we can review your search results, if you order a preliminary opinion at a cost of 2 trademarks or domain names for $45. NOTE: Preliminary search and opinion work is exactly what it says; preliminary. It is no substitute for a full search and opinion. That is because the preliminary work only searches for the exact version of the mark you are proposing, while a mark that is confusingly similar, and not identical, may be infringing. Furthermore, the preliminary search does not include unregistered marks, unless you opt to include a domain name search. However, even including domain names does not nearly provide adequate searching of unregistered marks. |
